Terms of purchase

These General Terms of Sale (hereinafter referred to as the “General Terms”) govern solely the contractual relationship between the customers of the website WWW.ZESTWATERFORLIFE.COM (hereinafter referred to as “Customers”) and the seller ZESTWATERFORLIFE WEBSTORE (hereinafter referred to as “ZEST GbR”). These General Terms are the only ones that apply and replace all other terms, except for prior, explicit, and written exceptions. ZEST GbR may be required to modify some of these provisions; therefore, it is recommended that Customers review the General Terms each time they visit the ZESTWATERFORLIFE.COM website (hereinafter referred to as the “Site”). These changes are effective from the moment they are posted on the website and do not apply to contracts made before their introduction. Any purchase on the Site is subject to the General Terms of Sale in force on the day the order is placed. By confirming an order, ZEST GbR assumes that Customers have read and accepted the General Terms of Sale without reservations. To place an order on the Site, Customers have several options:

The online ordering process consists of four (4) consecutive steps. After making a selection and confirming the cart, Customers must:

  1. Identify themselves,
  2. Choose the type and quantity of the product,
  3. Accept the General Terms of Sale by checking the appropriate box,
  4. Choose the payment method.

After selecting the payment method, Customers will need to make the payment for the order, which will ultimately formalize the sales agreement binding them to ZEST GbR. In the case of orders processed by bank transfer outside the website, the agreement becomes binding once the payment is received in the bank account specified to the customer for payment, already indicated on the website on the “payment methods” page.

ZEST GbR places particular importance on providing information regarding the key features of products ONLINE through technical data sheets and images illustrating the product, within the limits of technology and in accordance with the best market standards. Accessories offered in various packages and/or sets and sold on the Site are brands compatible with our products.

The sale prices listed on the Site are expressed in euros (€ 0.95), where indicated, and include VAT, shipping, and any accessories. VAT sales tax differs depending on the European Union country and non-EU country.

Shipping costs are always described in terms of whether they are included in the purchase procedure or not, depending on the product.

They are billed at the end of the order as an addition to the selected products, if not already included in the purchase price.

ZEST GbR reserves the right to change prices at any time, but commits to applying the prices listed on the Site at the time the order is placed.

Customer orders are processed based on the availability of products. If the ordered product is unavailable, ZEST GbR commits to contacting the Customer via email within 15 days from the order date to inform them about the delivery time of the ordered product.

Products purchased on the Site can be delivered

A) Within the entire European Union, including islands, except for rare exceptions already excluded from the purchase options (such as the Faroe Islands, etc.)

Note: Any payments that are suspicious or may indicate potential fraud with Shopify Payments will be immediately rejected without the need for communication from ZEST GbR. However, if the user prefers another method, such as a bank transfer, they must contact us using our contact details to receive instructions on deadlines and methods.

A payment made by bank transfer is considered binding for ZEST GbR for the purposes of the purchase agreement only once the currency has been credited to the account specified in the procedure.

Note: ZEST GbR does not accept cash payments unless special agreements are made directly with the company or its direct representatives. If a request for cash payment is received on behalf of ZEST GbR, it should be immediately reported to ZEST GbR and the relevant authorities.

Right of Withdrawal

The right of withdrawal is reserved solely for individuals, and therefore cannot be exercised by legal entities or individuals acting for purposes related to any business or professional activities unless the content of the purchase agreement indicates that it does not have a professional character, particularly based on the subject of the business activity registered in the Central Registration and Information on Business Activity.

To exercise the right of withdrawal, the customer must send a registered letter with acknowledgment of receipt within 15 to 30 days of receiving the goods, indicating the items they intend to return. The customer is responsible for the cost of returning the product.

The right of withdrawal is completely lost if the returned product is not in its original condition, i.e.:

  • Lack of original packaging
  • Missing integral parts of the product (accessories or other components, etc.)
  • Product damage

In any case, the customer will not be able to exercise the right of withdrawal if the products were damaged due to improper use in accordance with their intended purpose and warranty conditions. If the packaging remains unopened and is not damaged or hazardous to health, the withdrawal period is 15 days from the delivery date.

ZEST GbR will process the credit order (excluding shipping costs) within 30 business days from the return shipment by the customer, but in any case, not before receiving the goods.

ZEST GbR will consistently reject any returned product that is unpackaged, missing accessories, parts, or damaged (without prior communication according to warranty conditions, see the warranty page).

Shipping costs related to product returns are fully borne by the customers.

Only products in their original packaging and with all included accessories, free from damage, will be accepted for returns and payments.

Any damage or missing accessories will invalidate the return and, consequently, the refund. We will contact the customer regarding potential agreement between the parties.

  • Failures (and resulting consequences) caused by intervention from a workshop not authorized by Zest GbR

Under no circumstances is ZEST GbR responsible for a refusal of warranty coverage by the manufacturer for the reasons outlined above.

In cases where repair is not covered by the warranty, the manufacturer will provide a cost estimate.

If the cost estimate is not accepted, the manufacturer will charge for administrative costs. In the case of agreement, the customer will need to make a bank transfer equal to the cost estimate, on behalf of ZEST GbR.

The court in Garmisch-Partenkirchen, Germany, is competent to resolve any legal disputes related to the products and services of ZEST GbR.

ZEST GbR shall not be held responsible for non-performance of the contract due to force majeure, such as defined by German courts, or the responsibility of the customer or third parties. It is recommended and advisable to secure the data contained in the purchased products. ZEST GbR is not liable for damages resulting from improper use of products sold on the Website.
